These Terms of Service ("Terms") govern your access to and use of the Bear Pit Intelligence platform (the "Platform") operated by Bear Pit Intelligence ("we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms.
By accessing or using the Platform, you confirm that you are at least the age of majority in your province or territory of residence and that you have the authority to enter into these Terms, including, where applicable, on behalf of an organization. If you do not agree to these Terms, you may not use the Platform.
Bear Pit Intelligence is a software-as-a-service platform that aggregates, summarizes, and analyzes publicly available government-relations information related to the Province of British Columbia. The Platform uses artificial intelligence to generate summaries, briefings, and analysis. The Platform is intended for professional government-relations, public-affairs, and policy purposes.
To use most features of the Platform, you must create an account and provide accurate information. You are responsible for:

We may change plan features, pricing, or availability from time to time. Changes that materially reduce features available to existing subscribers will not take effect for that subscriber until their next renewal, except where required by law.
Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD AT THE THEN-CURRENT RATE, UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. You authorize us (and our payment processor, Stripe) to charge your payment method on file for each renewal.
You can cancel auto-renewal at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period; you retain access to the Platform until that date.
All listed prices are exclusive of applicable taxes. We will add Goods and Services Tax (GST), Provincial Sales Tax (PST), Harmonized Sales Tax (HST), or other applicable taxes to your invoice based on your billing address. You are responsible for any taxes, duties, or charges levied by any government authority.
From time to time we offer promotional pricing to early subscribers ("Founding Members"). The current Founding Member offer provides a 20% discount on the standard subscription price for the first 12 months of subscription, subject to the following:

Subscription fees are non-refundable except where required by law. We may, at our discretion, offer pro-rated refunds in exceptional circumstances. Briefing packs and other one-time purchases are non-refundable once consumed.
If a payment is declined or otherwise fails:
You agree not to use the Platform to:
The Platform allows you to create notes, tracking files, watchlists, and other content ("User Content"). You retain ownership of your User Content. By creating User Content within the Platform, you grant us a limited, non-exclusive license to store, process, and display your User Content solely to operate the Platform and provide services to you.
You are responsible for the legality, accuracy, and appropriateness of your User Content. You may not upload User Content that infringes any third-party rights or violates any law.
The Platform, including its software, interface, design, branding, content (excluding User Content and excluding publicly available source material), and AI-generated summaries and briefings, is owned by Bear Pit Intelligence and is protected by Canadian and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Platform during the term of your subscription, solely for your internal business purposes.
Source documents indexed by the Platform (Hansard, Orders in Council, news releases, lobbyist registry filings, etc.) are public records owned by their respective issuing authorities. We do not claim ownership of these source materials.
By using the Platform, you acknowledge and agree that:
While we take reasonable steps to improve the accuracy and reliability of AI output — including grounding briefings in specific source documents, applying source-citation requirements, and human review of certain outputs — we cannot eliminate the risk of error inherent to generative AI.
The Platform integrates with third-party services for hosting, authentication, AI processing, email delivery, analytics, and payment processing. Your use of the Platform is also subject to the terms and policies of those services. See our Privacy Policy for the current list of subprocessors.
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability. We do not warrant that the Platform will meet your requirements or that any defects will be corrected.
To the maximum extent permitted by law, in no event shall Bear Pit Intelligence, its directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, business opportunity, goodwill, data, or other intangible losses, arising out of or related to your use of, or inability to use, the Platform — whether based on contract, tort, statute, or any other legal theory, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability arising out of or related to these Terms or the Platform shall not exceed the amount you paid to us during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. To the extent any such exclusion or limitation is not permitted, our liability is limited to the minimum extent permitted by law.
You agree to defend, indemnify, and hold harmless Bear Pit Intelligence and its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or third-party right.
You may terminate your subscription at any time by cancelling through your account settings or by contacting us. Termination takes effect at the end of your current billing period.
We may suspend or terminate your access to the Platform, with or without notice, if:
Upon termination, your right to use the Platform ends immediately. Sections that by their nature should survive termination (including Sections 7, 8, 10, 11, 12, and 16) will survive.
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform at least 30 days before the changes take effect, where reasonably practical. Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Platform and may cancel your subscription.
The Platform may be in active development and may include features that are in beta. Beta features are clearly identified and are provided without warranty. We may modify, suspend, or discontinue beta features at any time.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Platform shall be resolved exclusively in the courts of British Columbia, and you consent to the personal jurisdiction of those courts.
